Terms of Service for Hueful

These Terms of Service (the “Terms”) govern your use of the Hueful mobile application (the “App”), developed and operated by Feel Refreshed Studio Limited (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

The App is a color contrast and accessibility verification tool that runs entirely on your device.

1. Acceptance of Terms

By using the App, you confirm that you can form a binding contract with us and that you accept these Terms and our Privacy Policy. These Terms apply to all users of the App.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, solely for your personal or internal business purposes, in accordance with these Terms and the Apple Media Services Terms and Conditions.

This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time, except as permitted by the App Store rules.

3. Restrictions

You agree not to, and not to permit others to:

• Copy, modify, adapt, translate, or create derivative works of the App;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent such restriction is prohibited by applicable law;
• Rent, lease, lend, sell, sublicense, or otherwise commercially exploit the App;
• Remove, alter, or obscure any proprietary notices in the App;
• Use the App in any unlawful manner or for any unlawful purpose.

4. Your Content

The App lets you create and store content on your device, such as color palettes, names, and notes (your “Content”). Your Content is stored locally on your device and is not transmitted to or stored by us. You retain all rights to your Content, and you are solely responsible for it and for backing it up. We have no access to, and assume no responsibility for, your Content.

5. Intellectual Property

The App and all of its contents — including software, design, text, graphics, logos, and the “Hueful” name — are owned by or licensed to Feel Refreshed Studio Limited and are protected by intellectual property laws. Except for the license expressly granted in these Terms, no rights are granted to you.

6. No Account; Free of Charge

The App does not require registration or an account, collects no personal data, and is provided free of charge. We make no commitment to keep the App, or any of its features, available indefinitely, and we may modify, suspend, or discontinue the App at any time.

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

The App provides color contrast and accessibility calculations (including WCAG and APCA metrics and color-vision-deficiency simulations) as informational aids only. These results are estimates and do not constitute legal, medical, or professional accessibility-compliance advice. You are responsible for independently verifying that your designs meet any applicable accessibility standards or legal requirements. We do not warrant that the App will be uninterrupted, error-free, or that any result will be accurate or reliable.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FEEL REFRESHED STUDIO LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Apple App Store — Additional Terms

These Terms are between you and Feel Refreshed Studio Limited only, and not with Apple Inc. (“Apple”). The following terms apply to your use of the App obtained through the Apple App Store:

• Scope. Apple is not responsible for the App or its content. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance and Support. We, not Apple, are solely responsible for providing any maintenance and support for the App, to the extent any such support is required. Apple has no obligation to furnish any maintenance or support services.
• Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Product Claims. We, not Apple, are responsible for addressing any claims relating to the App, including product liability, failure to conform to legal or regulatory requirements, and consumer-protection claims.
• Intellectual Property. In the event of any third-party claim that the App infringes intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
• Legal Compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not listed on any U.S. Government prohibited-or-restricted-parties list.
• Third-Party Beneficiary. You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Termination

These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of their provisions. Upon termination, you must stop using the App and delete all copies from your devices. You may terminate these Terms at any time by deleting the App.

11. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last Updated” date above. Material changes will be reflected in an updated version of the App or on this page. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law principles. You agree to submit to the non-exclusive jurisdiction of the courts of Hong Kong.
